eGift Card Terms and Conditions

JTV® Gift Cards ordered through this website are distributed by CashStar, Inc., a Delaware corporation (“CashStar”). Visit www.jtv.com for complete JTV Gift Card General Terms and Conditions, for JTV’s other Terms and Conditions and for JTV’s Privacy Policy. Purchase, redemption or use of JTV Gift Cards constitutes acceptance of the JTV Gift Card General Terms and Conditions, and you should read them carefully, as they include a binding arbitration provision and limitations on liability and damages.

By visiting www.jtv.cashstar.com, you also agree to the additional terms and conditions set forth below, as well as CashStar’s Privacy Policy and Site Terms of Use. The JTV Gift Card Terms may be modified or terminated at any time. Likewise, JTV and CashStar also reserve the right to change the additional terms and conditions set forth below from time to time in their sole discretion.

  1. Issuer, Terms and Distribution.

    JTV Gift Cards (the “Gift Cards” or “Gift Card” in the singular) are distributed by CashStar Inc., a Delaware corporation ("CashStar"). By purchasing, receiving or using a Gift Card, you agree to these terms and conditions ("Gift Card Ts & Cs"), which govern purchase, redemption and related issues concerning Gift Cards. JTV and CashStar reserve the right to change the Gift Card Ts & Cs from time to time in their sole discretion. Gift Cards are issued by America’s Collectibles Network, Inc. dba JTV® (“JTV or sometimes referred to as “ACN”). JTV can delegate its issuer obligations to an assignee, without recourse. If delegated, the assignee, not JTV will be the sole obligor to the owners of Gift Cards.
  2. Kinds of Gift Cards.

    JTV Gift Cards come in two varieties, “Physical Gift Cards” (typically plastic and shipped by a common carrier) and “eGiftCards” which are provided by email in the form of an electronic code. “Gift Cards” (or “Gift Card” in the singular) refers to both the Physical Gift Cards and the eGiftCards, for the purposes of these Gift Card Ts & Cs, except where specifically indicated otherwise.
  3. Purchase and Use of Gift Cards.

  4. Gift Cards can be purchased online at www.jtv.cashstar.com and by calling JTV’s call center at 1-800-619-3000 (available 24 hrs/day). Purchases of Gift Cards are not refundable and may not be returned once they are purchased.

    Gift Cards can be used to purchase JTV merchandise and services offered for sale on JTV’s television broadcast, online at JTV.com or viewed on a JTV mobile App. To use a Gift Card to make a purchase, call (800) 619-3000 (available 24 hrs/day) and have your Gift Card number available. The only fees charged in connection with Gift Cards are for expedited shipping (for Physical Gift Cards). Gift Cards have no expiration dates. Gift Cards may not be redeemed for JTV Drop Auction Merchandise.
  5. Payment Methods.

    Gift Cards may be paid for with valid credit cards, which include VISA, MasterCard, Discover, and American Express or a valid debit card. Your transaction to purchase the Gift Cards sold on this website will be directly between you and CashStar.
  6. Other Limitations.

    Gift Cards may not be used to purchase other Gift Cards or be applied as payment to balances on any credit cards (including any private label cards issued for JTV purchases) or as a payment on an existing installment plan. For more information on installment plans see JTV’s Terms and Conditions at www.jtv.com. Gift Cards are not refundable and cannot be redeemed for cash except to the extent otherwise permitted by law. Gift Cards are void if resold or transferred for value without authorization.

    Gift Cards may be loaded in value in the minimum amount of twenty-five dollars ($25) up to five hundred dollars ($500). The total value added to any single Gift Card may not exceed five hundred dollars ($500). Total purchases of Gift Cards for any one individual person in a single transaction may not exceed one thousand dollars ($1,000.00) and may not exceed ten thousand dollars ($10,000) for all Gift Card transactions one day (24-hour period).

    Gift Cards may be shipped to a physical address or to a U.S. Post Office Box via USPS as a standard method of shipment. For expedited shipment, UPS may be selected at check out, however expedited shipment requires a physical address for delivery and may not be delivered to a Post Office Box.
  7. Returns on Purchases Made Using a Gift Card.

    Returns of JTV merchandise and services, which are purchased in whole or part with a Gift Card, are subject to JTV’s standard return policies and procedures.

    For all returns on purchases made by redeeming a Gift Card in whole or part, JTV will credit your JTV account.

    Your refund will be allocated between the methods of payment you used for your original purchase. If you redeemed a Gift Card for the entire purchase amount of the item you are returning, a refund of that amount will be applied to your JTV account, less any charges connected with the return such as shipping (“Return Expenses”)

    Amounts paid using multiple methods of payment, such as a Visa and a Gift Card, will be refunded in the same amounts to the original method of payment and to your JTV account, less any Return Expenses.

    For example, imagine you bought a beautiful chrome diopside and zircon ring set in sterling silver for $89.99, and you snagged an offer with free shipping. To buy the ring, you use up the $50 balance on your plastic Gift Card and put $39.99 on your VISA card. You decide to return the ring. JTV would issue a $50 credit to your JTV account. In addition, JTV would credit your VISA card for $39.99.

    Returns on purchases made in whole or part using Brilliant Cash Rewards are subject to additional terms under the JTV Brilliant Cash Rewards Program. To see Terms and Conditions for the JTV Brilliant Cash Rewards Program visit www.jtv.com.
  8. Reloading.

    Gift Cards cannot be reloaded, Gift Card balances cannot be increased after purchase.
  9. Gift Cards Lost, Stolen or Used Without Authorization.

    PROTECT YOUR GIFT CARD AS YOU WOULD CASH. If it is lost or stolen or used without authorization, it will not be replaced.
  10. Delivery Information and Requirements for Gift Card Purchasers.

    All orders of Gift Cards are subject to a process that compares purchaser information provided on the web site with information about the purchaser provided by the purchaser's financial institution.

    If there is a discrepancy, your Gift Card order may be delayed until it can be corrected. If you have concerns about your order, please contact JTV by calling the JTV call center at 1-800-619-3000 (available 24 hrs/day), or by emailing jtvgiftcards@jtv.com. Please refer to your order number, or be ready to supply your email address. You may also visit www.jtv.com for additional information.

    We are not responsible for Gift Cards that are undeliverable or not received due to your failure to provide an accurate physical address or email address for the recipient. Please check to make sure the address of the recipient is correct and contact JTV by calling the JTV call center at 1-800-619-3000 (available 24 hrs/day), or by emailing jtvgiftcards@jtv.com if you suspect the recipient did not receive his/her Gift Card. Please refer to your order number, or be ready to supply your email address. Should an email be returned to us due to inaccurate delivery information for the recipient, we will attempt to contact you for a valid email address.   11. Reasons for Failed Delivery of an eGiftCard.

    eGiftCards are delivered via email. If you have confirmed the recipient's email address, but the eGiftCard has not been viewed within a reasonable period after the requested delivery date, the following is a list of the most common reasons why delivery may have failed:
    1. A spam filter blocked the email or routed it to a bulk/spam folder,
    2. The recipient's firewall blocked the email,
    3. The email inbox is over a size limit or
    4. The email address is invalid.
    If a spam filter is blocking Gift Card emails from getting to an inbox, the email options will need to be modified so that emails concerning the Gift Cards are not considered spam. This may include adding jtvgiftcards@cashstar.com as a safe sender to your email security options.   12. Personalized Messaging.

    If you wish to add a personal message to a Gift Card, simply type your message in the “Message” field during the purchase process. Personal messages are limited to the space provided on the eGiftCard or on the presentation carrier of a physical Gift Card. There is no additional charge to add a personalized message to your Gift Card. If we find any messages inappropriate, offensive or otherwise objectionable, we reserve the right to cancel them.
  13. JTV Terms.

    Please refer to www.jtv.com for additional Terms and Conditions that govern the relationship of Gift Card purchasers and recipients with JTV. JTV’s Gift Card General Terms and Conditions and JTV’s other Terms and Conditions govern a variety of subjects, such as the policies related to the return of merchandise. The Gift Card Ts and Cs supplement JTV’s Gift Card General Terms and Conditions, but if the Gift Card Ts and Cs conflict with JTV’s Gift Card General Terms and Conditions, the Gift Card Ts and Cs control.
  14. Checking Your Balance.

    To check your Gift Card balance, contact JTV by calling the JTV call center at 1-800-619-3000 (available 24 hrs/day), or by emailing jtvgiftcards@jtv.com. Please refer to your order number, or be ready to supply your email address. You may also visit www.jtv.com for additional information. The information on the Gift Card is required for all balance inquiries.
  15. Privacy.

    Information that you provide when purchasing Gift Cards is subject to CashStar's Privacy Policy. Please review this policy for further information.
  16. Risk of Loss.

    Ownership and risk of loss of eGiftCards passes to the purchaser as soon as we send our confirmation to the recipient. For physical Gift Cards, risk of loss passes to the recipient as soon as the Gift Card is delivered to the designated carrier. We are not responsible for Gift Cards that are lost, stolen or used without authorization.

  18. Limitation of Liability; Dispute Resolution.

    Visit www.jtv.com for complete JTV Gift Card General Terms and Conditions and JTV’s other Terms and Conditions regarding the resolution of disputes arising out of or relating to use of JTV Gift Cards, and the limitations of liability and damages applicable thereto. You should read the JTV Gift Card General Terms and Conditions and JTV’s other Terms and Conditions carefully. They require binding arbitration of most disputes instead of litigation in court, and affect legal rights that you may otherwise have.

    By visiting this site, you also hereby agree and consent that any dispute with CashStar relating in any way to JTV Gift Cards shall be governed by the laws of Tennessee, without reference to any rules regarding conflicts of law.

    NEITHER CASHSTAR, JTV NOR THEIR AFFILIATES MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF SO, YOU MAY HAVE ADDITIONAL RIGHTS.
